1. 1. ELIGIBILITY

   • This Promotion is open to citizens and permanent residents of Malaysia aged 18 years old and above.
   • All employees of Ferrero, its affiliates, subsidiaries, distributors, alliance partners, advertising, promotions and third-party agencies, and their relatives up to the second degree of consanguinity and affinity are disqualified from joining this Promotion.
   
   

2. 2. PRIZE DETAILS

   Participants may stand a chance to win 1 of 50 prizes (Kenwood Stand Mixer KVL85.004SI). Eligible participants with qualifying entries as well as the most creative responses will be selected as winners. Participants may only win once throughout the Promotion Period. Winners will be notified via their mobile number.

3. 3. HOW TO JOIN

   • To qualify for the promotion, participants must purchase participating Nutella at a minimum spend of RM35 from participating retailers in Malaysia. And tell us “Nutella is…”.
   • The products must be must be imported by Ferrero Malaysia Sdn. Bhd./ DKSH Malaysia Sdn. Bhd., B-11-01 The Ascent Paradigm, No. 1 Jalan SS7/26A Kelana Jaya, 47301 Petaling Jaya, Selangor, Malaysia only. Please check that “DKSH Malaysia Sdn Bhd” is indicated as the importer on product packaging to ensure eligibility for this Promotion. The purchase period must be from 1 October 2024, 00:00 Hrs to 31 October 2024, 23:59 Hrs.
   • * Only entries that have purchased the participating Nutella products (Spreads) distributed by DKSH Malaysia Sdn Bhd in Malaysia as indicated above are entitled to a chance to win.
   • Date of selection of winners: 2 November 2023, 1600 hrs, at 28 Senang Crescent Bizhub 28 #06-11 Singapore 416601.
   • To participate, visit www.nutellamy.com to upload your receipt / proof of purchase and enter your particulars. The receipt/proof of purchase should have the following printed clearly:
     • The name of the store where the products are purchased
     • Date of purchase (purchases made before the start date of the Promotion or after the end date of the Promotion will not be accepted);
     • Quantity and description of the products purchased; and
     • Receipt number
   • By sending your particulars and participating in this Promotion, you confirm that you have read, understood, and accepted these Terms and Conditions and Privacy Policy and you have agreed and consented that Ferrero and its service providers for this promotion may collect, use, disclose and process your personal data in connection with this Promotion.
   • Each valid receipt entitles participants to only one chance to participate in the Promotion. Participants may submit multiple receipts for multiple chances.

1. 4. SELECTION OF WINNERS

   Eligible participants with the most creative responses will be selected as winners as described in Part 3 above. Winner selection will be done by Ferrero on 5 November 2024.
   

2. 5. GENERAL RULES

   1. Participants can purchase participating Nutella products multiple times as long as each purchase meets the requirements of these terms and conditions.
   2. Winners shall be responsible for any additional costs, duties, taxes and/or other incidental expenses (if any) which may be incurred as a result of and/or related to the winners’ claiming and/or acceptance of the prize.
   3. No substitution or transfer of prize shall be permitted except at the option of Ferrero. Ferrero reserves the right to substitute a prize for equal value in place of advertised prizes that are unavailable.
   4. The outcome of the selection of winners is final and no correspondences will be entertained.
   5. The names of winners and the last 4 digits of their respective mobile numbers will be announced on the Nutella Website (www.nutellamy.com after 4 October 2024.
   6. By participating in this promo, participants agree to abide by and be bound by these Terms and Conditions and the decisions of Ferrero. Failure to comply with the said terms, conditions, rules, regulations, instructions, or methods will result in the participant's disqualification.
   
   

3. 6. CLAIMING OF PRIZES

   1. Upon announcement of winners, winners will be contacted by SMS on how to claim their prizes.
   2. Prizes will be delivered by Ferrero to the winners’ residence.
   3. Winners may be required to provide a copy of his/her Identity Card, Driving License or Passport for verification purposes.
   4. Delivery Start Date: 6 November 2024
   5. If the winners cannot be contacted or fail to provide the required details within 1 (one) week from SMS date, they will automatically be disqualified, and Ferrero reserves the right to choose another winner.
   6. No substitution or transfer of prize shall be permitted except at the option of Ferrero. Ferrero reserves the right to substitute a prize for equal value in place of advertised prizes that are unavailable.
   7. Acceptance of a prize constitutes permission to use the winner’s name and/or likeness for advertising purposes without further notice or compensation, unless prohibited by law.
   8. Ferrero and/or its affiliates shall not be liable to the participants in contract, tort or negligence or otherwise for any loss, damage, costs or expense of any nature whatsoever incurred or suffered by the participant and which is of indirect or inconsequential nature, including without limitation any economic loss or other loss. By participating in this Promotion and accepting the Prizes, the participants and winners waive any and all claims of liability against Ferrero and/or its affiliates, its employees and agents, for any injuries, losses, or damages of any kind caused by any Prize or resulting from the acceptance, possession or use or misuse of the Prize, or which may occur from the conduct of, or participation in, the Promotion, or while preparing for, participating in, and/or traveling to and from any prize-related activity. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied, by Ferrero. Ferrero does not guarantee any third party’s performance, nor does it guarantee any of the services or materials provided by any third party.
   9. Ferrero, its affiliates and subsidiaries shall not be liable to the participants in contract, tort or negligence or otherwise for any loss, damage, costs or expense of any nature whatsoever incurred or suffered by the participant and which is of indirect or inconsequential nature, including without limitation any economic loss or other loss.
   10. In no event shall Ferrero, its affiliates or subsidiaries be liable to the participants for any monetary amount greater than the value of the prizes due to the prize winner under the rules and regulations of this promotion.
   11. Ferrero reserves the right to amend the Terms and Conditions of this Promotion, as well as to suspend, modify or cancel the Promotion, as may be authorized by and in accordance with Singapore law, rules and regulations.
